These Terms of Service (“Terms”) govern your access to and use of Mosaik, including our website and macOS application (collectively, the “Service”). Mosaik (“Mosaik”, “we”, “us”, or “our”) is operated by a sole proprietor under German law.
By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree to these Terms, you may not use the Service.
Use of the Service
You may use Mosaik for your personal or internal business use only in compliance with these Terms and applicable law.
You may not:
- Copy, resell, sublicense, or redistribute the Service, except where applicable law expressly permits it
- Reverse engineer or attempt to extract source code, except where applicable law expressly permits it
- Use the Service in a way that interferes with its operation or infringes on others’ rights
Trial, Purchases, and Refunds
Mosaik offers a 3-day free trial before a one-time purchase is required.
Payments are processed by Polar (polar.sh). By making a purchase, you also agree to any applicable Polar terms required to complete the transaction.
If you experience an issue after purchase, contact hi@mosaiknotch.com within 14 days of purchase. We will try to resolve the issue or provide a refund if requested within that 14-day period.
License and Activation
We grant you a limited, non-exclusive, non-transferable license to use our Service in accordance with these Terms. This license may only be used actively on up to two devices you own.
Sharing or publicly distributing your license may result in its deactivation without a refund.
Activation of the license requires an internet connection and a valid license key.
Intellectual Property
Mosaik, including its design, branding, content, and software, remains the property of its owner.
These Terms do not transfer any ownership rights to you.
Disclaimer
To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
Availability and Changes
We may update, improve, suspend, or discontinue parts of the Service at any time.
We aim to keep the Service available and working as described, but we do not guarantee uninterrupted availability, ongoing compatibility with all systems, or that the Service will always be free from bugs or errors.
Limitation of Liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or business opportunities arising from or related to your use of the Service.
Termination
This license will terminate automatically if you fail to comply with these Terms. Upon termination, you must cease all use of the Service and delete all copies of the macOS application.
Changes to These Terms
These Terms of Service may be updated from time to time. When updated, the revised version will be posted on this page with a new effective date. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
